{"id":5112,"date":"2021-04-26T10:13:13","date_gmt":"2021-04-26T10:13:13","guid":{"rendered":"https:\/\/www.mhuv.gov.dz\/?p=5112"},"modified":"2021-04-26T10:13:13","modified_gmt":"2021-04-26T10:13:13","slug":"pos","status":"publish","type":"post","link":"https:\/\/www.mhuv.gov.dz\/?p=5112&lang=fr","title":{"rendered":"PLAN D\u2019OCCUPATION DES SOLS (POS)"},"content":{"rendered":"<p>&#8211; Loi <strong>n\u00b090.29 du 1<sup>ER<\/sup> d\u00e9cembre 1990<\/strong>, modifi\u00e9e et compl\u00e9t\u00e9e, relative \u00e0 l\u2019am\u00e9nagement et l\u2019urbanisme.<br \/>\n&#8211; D\u00e9cret ex\u00e9cutif <strong>n\u00b0 91.178 du 28 Mai 1991<\/strong>, modifi\u00e9 et compl\u00e9t\u00e9, fixant les proc\u00e9dures d\u2019\u00e9laboration et d\u2019approbation du POS.<\/p>\n<p><strong>PROCEDURES D\u2019ETABLISSEMENT\u00a0:<\/strong><\/p>\n<p><strong>1\/- INITIATION : (Loi n\u00b090.29\u00a0 \u00a0\/art 34)<\/strong><\/p>\n<p>Le Pr\u00e9sident de l\u2019Assembl\u00e9e Populaire Communale concern\u00e9e initie l\u2019\u00e9tude d\u2019un POS.<\/p>\n<p><strong>2\/- PRESCRIPTION : (D\u00e9cret n\u00b0 91.178 \/ art : 2, 3, 4, 7) <\/strong><\/p>\n<p>* D\u00e9lib\u00e9ration APC concern\u00e9e (s)<br \/>\n*Notification au Wali<\/p>\n<p>*Affichage durant un mois au si\u00e8ge APC (s)<br \/>\n* Notification aux diff\u00e9rentes associations locales d\u2019usagers qui disposent de quinze (15) jours pour faire conna\u00eetre si elles veulent \u00eatre associ\u00e9es \u00e0 l\u2019\u00e9laboration du POS.<br \/>\n* A l\u2019issue du d\u00e9lai de 15 jours, un arr\u00eat\u00e9 pr\u00e9cisant la liste des participants (administrations, organismes publics, associations) devant \u00eatre consult\u00e9s sur le projet, et pris par le Pr\u00e9sident d\u2019Assembl\u00e9e Populaire Communale (s) concern\u00e9s (s).<\/p>\n<p><strong>3\/- ELABORATION : (6 -12 mois)<\/strong><\/p>\n<p>Cette \u00e9tape regroupe l\u2019ensemble des phases de l\u2019\u00e9tablissement de l\u2019\u00e9tude du POS \u00e0 partir de l\u2019\u00e9tat de fait jusqu\u2019au r\u00e8glement en passant par l\u2019am\u00e9nagement et les VRD.<\/p>\n<p><strong>4\/- ADOPTION : (Loi n\u00b090.29\u00a0 \u00a0\/ art 35.36)<\/strong><\/p>\n<p>* Projet adopt\u00e9 par d\u00e9lib\u00e9ration de l\u2019APC(s) concern\u00e9e (s) (loi \/ art\/35).<br \/>\n* Notification aux administrations publiques, organismes et services de l\u2019Etat concern\u00e9s, qui<\/p>\n<p>disposent de 60 jours pour \u00e9mettre leurs avis et observations (d\u00e9cret \/ art 09).<br \/>\n* Mise \u00e0 l\u2019enqu\u00eate publique (60 jours) par arr\u00eat\u00e9 du PAPC concern\u00e9 (loi \/ art 36).<\/p>\n<p><strong>5\/- APPROBATION : (Loi n\u00b090.29\u00a0 \/ art 36)<br \/>\n<\/strong><br \/>\n* Transmission au Wali du POS \u00e9ventuellement modifi\u00e9 qui doit faire conna\u00eetre son avis dans les 30 jours \u00e0 compter de la r\u00e9ception du dossier.<br \/>\n* Approbation par d\u00e9lib\u00e9ration de l\u2019APC concern\u00e9e (loi \/ art 36).<br \/>\n* Notification \u00e0 : (d\u00e9cret \/ art 16)<br \/>\n&#8211; Chambre de commerce,<br \/>\n&#8211; Chambre de l\u2019Agriculture,<br \/>\n&#8211; Wali territorialement comp\u00e9tent<br \/>\n&#8211; Services de l\u2019Etat charg\u00e9 de l\u2019urbanisme au niveau de la wilaya concern\u00e9e<br \/>\n* Mise \u00e0 la disposition du public (loi \/ art 36).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>&#8211; Loi n\u00b090.29 du 1ER d\u00e9cembre 1990, modifi\u00e9e et compl\u00e9t\u00e9e, relative \u00e0 l\u2019am\u00e9nagement et l\u2019urbanisme. &#8211; D\u00e9cret ex\u00e9cutif n\u00b0 91.178 du 28 Mai 1991, modifi\u00e9 et compl\u00e9t\u00e9, fixant les proc\u00e9dures d\u2019\u00e9laboration et d\u2019approbation du POS.
